What happens to oil and gas production when 1/2 of Oklahoma is handed over to the Tribes

Recommended Posts

Two days ago The Supreme Court declared half of Oklahoma is now Indian land.  What will be the impact to oil and gas since the main hub for storage is in Cushing, Oklahoma?  Pipelines run all across the lands in Oklahoma which will now be owned by five tribes. Seven major crude pipelines now cross into Creek territory.   It doesn't take a rocket scientist to see how the Native Americans, with the help of well funded environmental groups, will shut down pipelines or force the renewals of the existing ROWs.

Tesoro High Plains has had a pipeline out of the Bakkan for 67 years which was sold to Andeavor in 2013 and then to Marathon in 2018.  On July 2 the company was ordered to shut down the pipeline by a lower court.  There is a ROW with 2 Nations but in 2018 they demanded payment to individuals.  So it would seem Marathon thought it could work with the tribes since the crude from the Bakkan went to their refinery and they'd negotiate to get the tribes to stop the shut down, but doesn't look like they had any luck.  The North Dakota oil production is down 30%.  So we'll see what happens now that the tribes have their hands on lands not previously held in Oklahoma.

It's strange not a word about this severe blow to oil and gas transportation and storage isn't even on the mentioned.  When the tribes start to throw around their weight for access across their lands, taxes imposed on the crude produced in Oklahoma and moving through the pipelines.  This is the biggest win for the environmentalists ever.  Yet, I don't see any real info about the consequences to what this could do to the nations energy infrastructure.  But, I bet Warren Buffett is dancing the jig right now.

Native American tribal leadership will do what they have always done. Get a bigger slice of the pie and tell the environmental community to move on we have what we came for.

This SCOTUS is a bigger mess than Dred Scott.

Osage County wasn't part of the first map, but was on the second one. Lots of big oilmen, including J. Paul Getty got their start under the "Million-Dollar Elm" tree, buying Osage tracts.

All of that may well be vacated, just as was the rape conviction of a guy who molested a four-year-old girl.

Similarly, it opened the door for reparations not only in Indian Territory but Oklahoma Territory--the whole state--which has been inhabited by as many as probably a hundred tribes.

The exit of the Trail of Tears brought thousands of slaves of Indians to Tulsa. That set the stage for the Tulsa Race Riot, the "Night they burned down Black Wall Street."

Neil Gorsuch has just set the country up for a Second Civil War. There must be a thousand Indian tribes that were once scattered all across the U.S. They settled along the Big Sur in California, the coast of Oregon, in Florida and Texas. The SCOTUS decision has set a striking precedence.

The state of Oklahoma is in negotiation with the Creek Nation. Reparations will most likely bankrupt the state coffers. The net/net of that will be lost revenue and a striking--maybe crippling--reduction in services. This will absorb as many lawyers as they can turn out. What a mess!

Far as I know this is only about jurisdiction.  Ownership isn't at issue.

About two weeks ago the Indigenous Environmental Network joined 16 frontline and climate justice organizations across the U.S. to create the United Frontline Table which is funded with almost a billion dollars to fight the oil and gas industry on Indian lands.  They are also front and center on shutting down an existing pipeline in the Bakkan over a small amount of surface acres held by the tribe.  This is also the group who wields power in Washington and is pushing to remove Mount Rushmore.  The tribes leadership is a whore to the environmental groups and their big dollars and power.
