If you'll re-read my previous statement, I said Democrats (currently the perpetrator - not always, but currently) are purposefully hand picking judges (that are already in place) that they know will rule favorably on the issue they are trying to push through. These judges may have been appointed by a republican, independent or democrat. It makes no difference (though, while some republican judges try to legislate from the bench as well, this trend is less common, particularly currently given the Democrats are the current party perpetrating this particular maleficence.)
