Today, a federal court  unsealed a two-count indictment returned by a federal grand jury in the Central District of California charging Alexander Smirnov, 43,  with making a false statement, in violation of 18 U.S.C. § 1001, and creating a false and fictitious record, in violation of 18 U.S.C. § 1519, for statements he made that were recorded in an official record of the Federal Bureau of Investigation (FBI) known as a Form 1023. 

David C. Weiss, Special Counsel, made the announcement.

On February 14, 2024, a federal grand jury returned the indictment and Smirnov was arrested at the Harry Reid International Airport in Las Vegas, Nevada, after his arrival in the U.S. from overseas.   Later today, Smirnov will have an initial appearance at the federal courthouse in the District of Nevada at 2:30 p.m. pacific time.

According to the indictment, Smirnov was a confidential human source (CHS) with the FBI.  As alleged in the indictment, despite repeated admonishments that he must provide truthful information to the FBI and that he must not fabricate evidence, Smirnov provided false derogatory information to the FBI about Public Official 1, and Businessperson 1, the son of Public Official 1, in 2020, after Public Official 1 became a presidential candidate. 

The indictment alleges that in March 2017, Smirnov reported to an FBI Agent that he had had a phone call with the owner of Ukrainian industrial conglomerate Burisma Holdings, Limited concerning Burisma’s interest in acquiring a U.S. company and making an initial public offering (IPO) on a U.S.-based stock exchange.  In reporting that conversation to the FBI Agent, Smirnov also noted that Businessperson 1, Public Official 1’s son, was a member of Burisma’s Board, a fact that was publicly known.  The indictment alleges that Smirnov provided no further information.

Three years later, in June 2020, the indictment alleges that Smirnov reported, for the first time, two meetings in 2015 and/or 2016.  As alleged in the indictment, Smirnov falsely claimed that during these meetings, executives associated with Burisma, admitted to him that they hired Businessperson 1 to “protect us, through his dad, from all kinds of problems,” and later that they had specifically paid $5 million each to Public Official 1 and Businessperson 1, when Public Official 1 was still in office, so that “[Businessperson 1] will take care of all those issues through his dad,” referring to a criminal investigation being conducted by the then-Ukrainian Prosecutor General into Burisma and to “deal with [the then-Ukrainian Prosecutor General].” 

As alleged in the indictment, the events that Smirnov first reported to the FBI Agent in June 2020 were fabrications.  In truth and fact, the defendant had contact with executives from Burisma in 2017, after the end of the administration when Public Official 1 had no ability to influence U.S. policy and after the Ukrainian Prosecutor General had been fired in February 2016. The indictment alleges that the defendant transformed his routine and unextraordinary business contacts with Burisma in 2017 and later into bribery allegations against Public Official 1 after expressing bias against Public Official 1 and his presidential candidacy.

As further alleged in the indictment, when he was interviewed by FBI agents in September 2023, Smirnov repeated some of his false claims, changed his story as to other of his claims, and promoted a new false narrative after he said he met with Russian officials.

If convicted, he faces a maximum penalty of 25 years in prison.  Actual sentences for federal crimes are typically less than the maximum penalties. A federal district court judge will determine any sentence after taking into account the U.S. Sentencing Guidelines and other statutory factors.

§201. Bribery of public officials and witnesses

(a) For the purpose of this section-

(1) the term "public official" means Member of Congress, Delegate, or Resident Commissioner, either before or after such official has qualified, or an officer or employee or person acting for or on behalf of the United States, or any department, agency or branch of Government thereof, including the District of Columbia, in any official function, under or by authority of any such department, agency, or branch of Government, or a juror;

(2) the term "person who has been selected to be a public official" means any person who has been nominated or appointed to be a public official, or has been officially informed that such person will be so nominated or appointed;

(3) the term "official act" means any decision or action on any question, matter, cause, suit, proceeding or controversy, which may at any time be pending, or which may by law be brought before any public official, in such official's official capacity, or in such official's place of trust or profit;

(4) the term "foreign official" means-

(A)(i) any official or employee of a foreign government or any department, agency, or instrumentality thereof; or

(ii) any senior foreign political figure, as defined in section 1010.605 of title 31, Code of Federal Regulations, or any successor regulation;

(B) any official or employee of a public international organization;

(C) any person acting in an official capacity for or on behalf of-

(i) a government, department, agency, or instrumentality described in subparagraph (A)(i); or

(ii) a public international organization; or

 

(D) any person acting in an unofficial capacity for or on behalf of-

(i) a government, department, agency, or instrumentality described in subparagraph (A)(i); or

(ii) a public international organization; and

 

(5) the term "public international organization" means-

(A) an organization that is designated by Executive order pursuant to section 1 of the International Organizations Immunities Act (22 U.S.C. 288); or

(B) any other international organization that is designated by the President by Executive order for the purposes of this section, effective as of the date of publication of such order in the Federal Register.

 

(b) Whoever-

(1) directly or indirectly, corruptly gives, offers or promises anything of value to any public official or person who has been selected to be a public official, or offers or promises any public official or any person who has been selected to be a public official to give anything of value to any other person or entity, with intent-

(A) to influence any official act; or

(B) to influence such public official or person who has been selected to be a public official to commit or aid in committing, or collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the United States; or

(C) to induce such public official or such person who has been selected to be a public official to do or omit to do any act in violation of the lawful duty of such official or person;

 

(2) being a public official or person selected to be a public official, directly or indirectly, corruptly demands, seeks, receives, accepts, or agrees to receive or accept anything of value personally or for any other person or entity, in return for:

(A) being influenced in the performance of any official act;

(B) being influenced to commit or aid in committing, or to collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the United States; or

(C) being induced to do or omit to do any act in violation of the official duty of such official or person;

 

(3) directly or indirectly, corruptly gives, offers, or promises anything of value to any person, or offers or promises such person to give anything of value to any other person or entity, with intent to influence the testimony under oath or affirmation of such first-mentioned person as a witness upon a trial, hearing, or other proceeding, before any court, any committee of either House or both Houses of Congress, or any agency, commission, or officer authorized by the laws of the United States to hear evidence or take testimony, or with intent to influence such person to absent himself therefrom;

(4) directly or indirectly, corruptly demands, seeks, receives, accepts, or agrees to receive or accept anything of value personally or for any other person or entity in return for being influenced in testimony under oath or affirmation as a witness upon any such trial, hearing, or other proceeding, or in return for absenting himself therefrom;

shall be fined under this title or not more than three times the monetary equivalent of the thing of value, whichever is greater, or imprisoned for not more than fifteen years, or both, and may be disqualified from holding any office of honor, trust, or profit under the United States.

Comer Releases Direct Monthly Payments to Joe Biden from Hunter Biden’s Business Entity

 

WASHINGTON—Today, House Committee on Oversight and Accountability Chairman James Comer (R-Ky.) released subpoenaed bank records revealing Hunter Biden’s business entity, Owasco PC, made direct monthly payments to Joe Biden. Hunter Biden is currently under an investigation by the Department of Justice for using the Owasco PC corporate account for tax evasion and other serious crimes. 

Following subpoenas to obtain Biden family associates’ bank records, Chairman Comer issued subpoenas for Hunter and James Biden’s personal and business bank records. The House Oversight Committee has identified over 20 shell companies and uncovered how the Bidens and their associates raked in over $24 million dollars between 2015 and 2019 by selling Joe Biden as “the brand.” Financial records obtained show Hunter Biden’s business account, Owasco PC, received payments from Chinese-state linked companies and other foreign nationals and companies.

Payments to Joe Biden from Hunter’s Owasco PC corporate account are part of a pattern revealing Joe Biden knew about, participated in, and benefited from his family’s influence peddling schemes. As the Bidens received millions from foreign nationals and companies in China, Russia, Ukraine, Romania, and Kazakhstan, Joe Biden dined with his family’s foreign associates, spoke to them by speakerphone, had coffee, attended meetings, and ultimately received payments that were funded by his family’s business dealings.

Chairman Comer today released a video outlining the direct payments Joe Biden received from Hunter’s Owasco PC bank account and stated the House Oversight Committee will continue to follow the money to ensure accountability for President Biden’s involvement in his family’s corrupt domestic and international business schemes.

Galanis, who is serving a 14-year prison sentence for conspiracy to commit securities fraud, securities fraud, and investment adviser fraud in addition to other crimes, was described in court documents as a “mastermind” of a fraud scheme in which he and Archer worked to convince a Native American tribe to issue economic development bonds, which allowed Galanis to divert the proceeds for his own personal use.

 

Galanis was also previously convicted of participating in a market manipulation and fraud scheme in which he also evaded a Securities and Exchange Commission (SEC) order prohibiting him from serving as an officer or executive at publicly traded companies. At the time, then Acting US Attorney for the Southern District of New York Audrey Strauss said that Galanis had “orchestrated two multimillion-dollar fraud schemes, and hid behind a team of co-conspirators to conceal his involvement and defy an SEC ban”.

Despite his history of deception, leaders of the Republican-led committees had hoped Galanis would link Mr Biden to his son’s business ventures even though a string of other witnesses — including Archer — had failed to do so.

The failure of Galanis to connect the president with his son’s various business endeavours is just the latest in a succession of embarrassing milestones in the years-long House probe, which has thus far been unsuccessful in finding any justification for impeaching the president.

Judges are not "for" anyone if they are real judges, they follow the law.

Yes, trump appointed some of the judges but even they have already ruled against him in cases.

Do you want the judges to follow the law or support "No Rules" Trump and end law all together?  Without the constitution do you have any rights or courts? No.

Zero chance Trump wins 70-30.  Heck when he won it was with less than 50% of the vote, then he lost the next time...

Viral social media posts have falsely claimed that President Donald Trump invoked the Insurrection Act of 1807 law to deploy American soldiers to police US streets. That didn’t happen.

The unfounded posts have gained traction in the wake of the US Capitol breach on Wednesday that engulfed the nation’s capital in chaos and left five dead, including an officer with the US Capitol Police.

While the law provides ample legal footing for presidents to deploy the military if they so choose, in practice it’s been used sparingly. The most notable application of the law was perhaps its invocation to enforce desegregation in the 1950s.

What is the Insurrection Act?

The main provision of the Insurrection Act states that troops can only be deployed to an American state by the President if the governor or state legislature requests it.

Another provision of the law, however, outlines that under certain limited circumstances involved in the defense of constitutional rights, the President can send troops unilaterally.

“Historically and practically, such a request is not necessarily a prerequisite to the President using regular federal troops for domestic law enforcement,” Stephen Vladeck, a University of Texas law professor and CNN contributor, previously told CNN of the law.

Now this is quite interesting...since the Supreme Court has stepped into the litigation of Trumps alleged misconduct the entire Insurrection debacle is falling apart. Even the lower courts are stepping in, things are becoming quite uncomfortable for the US legal system.

Appeals court tosses Jan. 6 sentence in ruling that could affect more than 100 cases

The ruling by a three-judge panel raises the possibility that more than 100 defendants may be resentenced over their role in the attack on the Capitol.

More than 1,300 defendants have been charged in connection to the Jan. 6 riot. Around 750 have pleaded guilty to federal charges, and about 785 have been sentenced.

My postion or suspicion..it was a disposition not a trial. Trials only come if there is merit.

However Mr. Biden might very agree to a public hearing now that the questions have been answered to the best of his abilities.  How this all ends...Let the Drama Unfold.
